These Terms of Service ("Terms") apply to your access to orthodome.com and your use of services provided by OrthoDome Inc. ("OrthoDome," "we," "us," or "our"). By accessing our website, booking a demo, creating an account, signing an order form, or using OrthoDome, you agree to these Terms and any written agreement between you and OrthoDome.
If a separate signed agreement, statement of work, order form, data processing addendum, or similar document applies, that document controls where it conflicts with these Terms.
OrthoDome Services
OrthoDome provides digital services for orthopedic practices, which may include custom websites, hosting, DomeChat or intake workflows, lead management, SEO and GEO support, managed newsletters, reporting, analytics, integrations, support, and related services.
OrthoDome is not a orthopedic practice, does not provide orthopedic surgeon guidance, and does not create an orthopedic surgeon-client relationship with any visitor, lead, client, or customer. Orthopedic practices remain responsible for orthopedic surgeon guidance, professional judgment, client relationships, conflict checks, fee agreements, confidentiality, and compliance with all applicable rules.
Customer Responsibilities
You are responsible for:
- Ensuring you have authority to use OrthoDome on behalf of your practice or organization.
- Providing accurate information, timely approvals, required access, brand assets, practice details, and feedback.
- Reviewing and approving website content, advertising claims, disclaimers, intake flows, newsletters, and client communications.
- Complying with bar rules, advertising rules, privacy laws, confidentiality duties, consent requirements, and other legal or professional obligations.
- Maintaining the security of your accounts, passwords, systems, and third-party integrations.
Acceptable Use
You may not use OrthoDome to violate law, infringe rights, mislead consumers, send unlawful or abusive communications, upload malicious code, scrape or reverse engineer the service, attempt unauthorized access, interfere with service operations, or process information in a way you are not legally allowed to process.
Plans, Fees, And Cancellation
Fees, plan details, billing terms, included services, launch timelines, cancellation rights, and any promotional guarantees are described on the applicable pricing page, order form, statement of work, or written agreement. Unless a written agreement says otherwise, subscriptions are billed in advance and fees are non-refundable once a billing period begins, except as expressly provided by the OrthoDome 30-Day Money-Back Guarantee: if you are not satisfied within 30 days after your website goes live, you may request a full refund in writing.
OrthoDome may suspend or terminate access for non-payment, unlawful use, security risk, material breach, or conduct that may harm OrthoDome, our customers, service providers, or the public.
Third-Party Services
OrthoDome may integrate with or rely on third-party services, including hosting providers, analytics platforms such as Google Analytics, payment processors, email providers, scheduling tools, CRM systems, domain registrars, search engines, advertising platforms, and other software providers.
Third-party services are governed by their own terms and privacy policies. OrthoDome is not responsible for third-party outages, API changes, account restrictions, platform policy changes, data loss, pricing changes, or other issues outside our control.
Content, Approvals, And Ownership
You represent that you have the rights needed to provide content, trademarks, images, client reviews, testimonials, logos, case results, and other materials to OrthoDome. You grant OrthoDome the rights needed to use those materials to provide the services.
Unless a written agreement says otherwise, customer-specific website copy, page content, and media created for your practice are owned by you after payment of applicable fees. OrthoDome retains ownership of its platform, templates, code, workflows, tools, know-how, processes, analytics methods, reusable components, and pre-existing intellectual property.
Analytics And Performance
OrthoDome may help configure analytics, reporting, attribution, SEO, GEO, conversion tracking, or campaign measurement. Analytics and marketing results are estimates and may vary based on browser settings, consent settings, platform limitations, traffic sources, third-party tools, and market conditions. We do not guarantee specific rankings, leads, patients, revenue, or outcomes unless expressly stated in a signed agreement.
Privacy
Our handling of personal information is described in the OrthoDome Privacy Policy. Customers are responsible for providing any privacy notices, cookie disclosures, and consents required for their own websites, leads, patients, and users.
Disclaimers
OrthoDome and orthodome.com are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, OrthoDome disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, error-free operation, and guaranteed business results.
Limitation Of Liability
To the fullest extent permitted by law, OrthoDome will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption. OrthoDome's total liability for claims relating to the services will not exceed the amounts paid to OrthoDome for the affected service during the three months before the event giving rise to the claim, unless a signed agreement states a different limit.
Communications
By submitting a form or providing your contact information, you consent to receive phone calls, text messages (SMS/MMS), and emails from OrthoDome related to your inquiry and our services. These communications may use automated technology. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of text messages at any time.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of OrthoDome will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
Dispute Resolution
Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at sales@orthodome.com. If the dispute is not resolved within 30 days, either party may proceed with formal legal action in accordance with the governing law section above.
Indemnification
You agree to indemnify, defend, and hold harmless OrthoDome, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable orthopedic surgeon fees) arising from your use of the services, your violation of these Terms, or your violation of any third-party rights.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Changes To Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice where appropriate. Continued use of OrthoDome after updated Terms become effective means you accept the updated Terms.
